Standing Up for the Rights of Clients in High Dollar Divorces
When dealing with high end divorces, money is often at the heart of the case. Both sides are attempting to get out of the marriage with as many assets as possible. It is important to understand that while property and assets are divided according to the laws of equitable distribution, alimony is determined by the courts while child support is determined according to state-set guidelines.

Spousal Support (Alimony)
Due to the high dollar value of most of our clients' cases, spousal support is almost always an issue. One spouse is attempting to limit the amount of money that he or she must pay to the other spouse, while the other spouse is attempting to get as much money as he or she can in order to maintain the lifestyle to which he or she had become accustomed to during the marriage. Regardless, the court looks at a variety of different factors when determining how much alimony should be ordered, including:
- Length of the marriage
- Ages of the parties
- Financial and other contributions made by each party to the marriage
- Health of the parties
- Fault in the marriage
- If there are children or not
Child Support
Child support is determined by a formula and is calculated using numbers that are statutorily set in the state child support guidelines. Some of the numbers that are used in the calculations include the income of each parent as well as the number of children. Health care, day care and schooling expenses may also be considered.
